Scarlett was in chambers as a protege of Samuel Romilly and it seems highly likely he knew Mackintosh, at whose house Godwin first encounters him in 1796 and meets him again in 1799. In March 1819 Scarlett supports Mackintosh to an appointment to a select committee on criminal law. Scarlett had contributed to Romilly and Dumont's Letters containing an account of the late revolution in France, in 1792.

Godwin's note in October 1819 'Instructions for Scarlett in 1819 5pp' interestingly seems to be Godwin drafting advice to Scarlett. Scarlett was then the prosecutor of the radicals on the platform at Peterloo, and it is possible Godwin hoped to influence his conduct. Godwin also called on Scarlett three days later. In the event Scarlett proved an extremely effective tool for the government - although continuing sympathy for reform is indicated in his resistance the following year to new legislation on sedition.
